Landlord Responsibilities Under Massachusetts Law
Massachusetts law outlines clear responsibilities for landlords regarding snow and ice removal:
- General Responsibility:
Landlords are primarily responsible for snow and ice removal and cannot delegate this responsibility to tenants through the lease, except in specific circumstances.- Exception: If the rental unit has a unique entrance not shared with other units, the lease may require the tenant to remove snow and ice from that entrance only. However, this exception does not extend to driveways, parking areas, or shared spaces.
- Egress and Safety:
Landlords must ensure that all exits, including exterior stairways, fire escapes, egress balconies, and bridges, remain free of snow and ice. - Liability:
Landlords are legally liable for slip-and-fall incidents on the property, regardless of any arrangements with tenants for snow removal. Liability can include damages such as medical bills, lost work, and physical or emotional suffering. - Local Ordinances:
Some cities and towns in Massachusetts require property owners to clear snow and ice from public sidewalks abutting their properties. These ordinances may include penalties for violations. - Lease Language:
